Q But I do listen to Pandora on my phone while driving. If I'm changing the song and a cop pulls me over, am I doing anything illegal?

A Maybe. Art-the-CHP-Man says a cop most likely "would not cite you for talking on the cell phone; however, the officer could cite you for distracted driving, by using section 22350 VC (unsafe speed for the conditions of the road) if you were observed to be swerving or somehow driving carelessly."

Q You often write about teen drivers glued to their cellphones and texting. What do teens say? Do they understand the risks they run?

Also, new teen drivers can attend the CHP's Start Smart classes with one of your parents. Go to www.chp.ca.gov/community/startsmart.html to sign up. I highly recommend the class.

Q I see a lot of people on cell phones as I walk kids and dogs or drive around on our residential streets. What would be a good way to indicate to them that they should hang up and drive? Or would that be risking road rage and they might drive over me?

A I understand your frustration, but remain calm and do nothing. I once yelled at a cellphone yakker who promptly and loudly told me where to go, so now I usually just focus on keeping my eyes on the road.

Q Is it OK in California (for passengers only) to use directional EMP devices to blow out the cellphone of the talker/texter/tweeter driving next to you, or has the law caught up with the technology?

A No. And a correction is in order. Last week the CHP inadvertently released some bad info. New state law allows drivers to store insurance information on an electronic device, but not one's auto registration. Drivers need to show a cop a paper copy of that document if asked.

Q My commute has been choked in the morning where the metering lights are off at the Westborough and Avalon entrances to Interstate 280. Whom do I contact to get them fixed? ... The metering lights on the Hillsdale Boulevard ramp to 101 have been nonfunctional for more than six months. Without metering, it makes an already congested area much worse. I have written to Caltrans twice during the past few months with no resolution. Can you get Caltrans to act?

A The lights at Westborough and at Hillsdale were knocked down and are on Caltrans' long repair list. The wiring for the light at Avalon most likely was a victim of vandals.

Q Capitol Expressway was paved a few months ago from Silver Creek Valley Road to Eastridge, but it is rough and uneven on both sides. Is this going to be fixed? I thought something was wrong with my tires when I encountered it. To me, it seems like such a terrible job was done.

A It's not going to get smoother. The county put down a thin surface in what is called microsurfacing, as opposed to a thicker and more expensive overlay that would have made the surface smoother.

Why? Trying to stretch scarce paving dollars. Microsurfacing is a thin sacrificial layer of pavement that protects the more expensive asphalt underneath. It has a coarser finish than a more densely graded overlay, increasing skid resistance and improving safety. The trade-off is an increase in tire noise, which county engineers say is often perceived as rough or uneven pavement.
