Milpitas Police Department plans to file its investigation into last week's solo vehicle injury crash on Calaveras Road with the Santa Clara County District Attorney's Office.

"It's going to be sent to the DA's office for review and they'll determine whether to file charges or not in this case," Milpitas police Lt. Henry Kwong said Monday.

He said the case is expected to be filed with the district attorney's office this week.

On March 19 at 12:44 p.m., Milpitas police and fire department personnel found a heavily damaged Honda Civic had driven into the bed of Los Coches Creek that runs alongside Calaveras Road in the hills. Two people were trapped inside a 29-year-old San Jose woman and her 3-year-old daughter.

The woman driver sustained moderate to major injuries. Firefighters used equipment including a basket stretcher and ropes to bring the woman up the embankment to the nearby roadway.

The girl appeared to have minor injuries, partly due to her car seat, rescuers said.

Both patients were transported to Valley Medical Center for treatment of their non-life threatening injuries.

This week, Kwong confirmed the woman had not been cited. He could not confirm the cause of the car crash. Investigators last week said speed appeared to be a factor. A witness said she saw the same car pass her nearby at a high rate of speed before the crash.
