The Santa Clara County Board of Education has voted to appoint a replacement for the board seat left vacant when trustee Darcie Green resigned.

Green, who stepped down March 19 because of uncertainty over whether the board used the proper residency boundaries when appointing her in October, said Thursday she would reapply for her seat.

"I am planning on participating in the appointment process," she said.

The board Wednesday night decided to make a provisional appointment, rather than calling an election for the Trustee Area 6 seat, representing East San Jose. The term extends through November 2014.

The board set a deadline of 5 p.m. April 22 to receive applications. It will interview candidates at a public meeting and may make an appointment at a board meeting in May. Applicants for the seat must be registered voters in Trustee Area 6, which represents the Oak Grove School District, Evergreen School District, Franklin-McKinley School District and the corresponding portion of East Side Union High School District. Residency in Area 6 made be verified by calling the Santa Clara County Office of Education at 408-453-6869.

The board had appointed Green in the fall to replace Craig Mann, who resigned to run for a seat on the San Jose-Evergreen Community College board.

When advertising and filling the vacancy, the board used new boundaries for Trustee Area 6, established when lines were redrawn in a redistricting process in February 2012. Green's Alum Rock home was within the new boundaries.

But in January, at the request of two unidentified people, Santa Clara County District Attorney Jeff Rosen wrote the board that it should have used the former boundaries for Trustee Area 6 when replacing Mann. The board's legal firm, Lozano Smith, had advised using the new boundaries.

To head off further legal disputes -- such as an appeal to the state attorney general -- Green resigned last month and said she planned to move to an undisputed area.

Employees of the Santa Clara County Office of Education or any school district are not eligible.

The county board sets the policies and budget for the Santa Clara County Office of Education and hears appeals of inter-district attendance requests and student expulsions.
