Stan Park, 40, is ordered to return to the Long Beach Superior Court on Jan. 23 for the start of jury selection.
He is charged with murder and weapons violations for the 2008 shooting death of Michael Martoni, 36.
Park's first trial ended in deadlock in 2011, with the jury voting 11-to-1 in favor of guilt.
Witnesses told police the two men, both Belmont Shore residents, got into a heated argument outside Yankee Doodles, 4100 E. Ocean Blvd., around closing time. The confrontation turned physical after Martoni threw the first punch. and ended when Park shot Martoni.
Defense Attorney Henry Salcido maintained in the first trial the shooting was in self defense after the much larger Martoni attacked Park.
Deputy District Attorney Steve Schreiner argued Park did not have to shoot Martoni, nor did he have to keep shooting the victim once Martoni was on the ground.
Park, who has remained in custody in lieu of $4 million bail since his last trial, faces the possibility of a life term if convicted on all counts.
