The female victim in the case, only referred to as Jane Doe in court proceedings, testified in Solano County Superior Court that she met up at a friend's apartment in Berkeley to celebrate a birthday on Sept. 24, 2011. After a number of vodka-based drinks, the victim and several others left for Oakland to have more drinks, hopping from bar to bar.
According to the victim's testimony, one of her last memories of the night was being in a bar and then waking up in an unknown location with a man on top of her having sex with her.
She identified that man in court as 39-year-old Howard K. Forbes.
On Wednesday, retired El Cerrito police Detective Jeff Doty testified to obtaining the surveillance footage from the bar that the victim was last believed to have visited.
Referring to the bar footage, Doty testified to seeing the victim arrive with her friends and leave alone. A man would follow her down the street and out of the camera's view.
While Doty testified that he couldn't positively identify the individual following the victim, prosecutors allege that it was Forbes.
The victim couldn't recall how she got to Forbes' Vacaville home in the early morning hours of Sept. 25, 2011, or whether she agreed to go.
A Contra Costa County District Attorney's Office criminalist, who analyzed a blood alcohol sample from the victim, testified that he came up with an average blood alcohol level of .20 at around the time she left the bar. At that level, a "naive" drinker could experience a blackout, he testified.
While the victim's memory of the events that took place in Forbes' home was hazy, she did testify about two blocked attempts to leave.
She also testified to one memory of being strangled and raped.
Around 6 a.m., Forbes drove her to a fast-food restaurant in El Cerrito, where he dropped her off, according to the victim's testimony.
Authorities were called to the scene and the victim was taken to a hospital for a sexual assault exam. The nurse who performed the exam testified that she sustained a black eye and bruising on her neck, arms and under her chin.
The trial is set to resume at 9: 30 a.m. today in the Fairfield courtroom of Judge E. Bradley Nelson, where Forbes' defense counsel, Deputy Public Defender John Mendenhall, is expected to begin the defense case.
Forbes remains in Solano County Jail, with bail set at $5.25 million. He is charged with kidnapping to commit rape, sodomy, assault, two counts of oral copulation by force and three counts of rape by means of force. A number of the charges carry an enhancement for great bodily injury and prosecutors allege that Forbes has a prior conviction for a lewd act.
