A man was sentenced to 180 days in jail Wednesday for firing a gun during a confrontation in San Rafael.
Leonard Keith Alfonso, 32, of Richmond was arrested last May after an incident at his girlfriend's home in the Canal area. Alfonso pulled the gun when the woman's ex-boyfriend came into the home at 5:30 a.m.
The ex-boyfriend told police Alfonso pressed the gun to his head before firing in a different direction.
Defense attorney Jon Rankin sought a 90-day sentence, saying Alfonso thought he needed to protect himself and his girlfriend. Rankin also said his client has no prior criminal record.
"He's sorry," Rankin told Judge Kelly Simmons.
Prosecutor Michael Wear sought the 180-day sentence, noting that Alfonso fired the gun in an area populated with children and families.
The judge imposed the higher sentence.
"Guns kill people," Simmons said. "He fired a shot, and he fired a shot in a residential neighborhood."
Alfonso is scheduled to turn himself in May 2 to start his jail sentence if he is denied home detention on a bracelet.
