MARTINEZ -- A defamation and malicious prosecution lawsuit filed by a former Contra Costa deputy district attorney against the county and several current and former District Attorney's Office staff members has been scheduled to go to trial May 4, 2015, in San Francisco federal court.
Michael Gressett was arrested in September 2008 and charged with raping a junior prosecutor in the DA's Office. He claimed the sex was consensual. The case, a hot-button issue during the 2010 district attorney race won by Mark Peterson over Dan O'Malley (one of the defendants in Gressett's lawsuit), was dismissed in 2011 before going to trial.
Gressett's first malicious prosecution civil suit was dismissed last May. He refiled in June. He remains on paid administrative leave from the county.
