San Jose police on Wednesday announced the April 11 death of a 17-month-old boy has now been ruled a homicide.
Police on Friday arrested Alejandro Benitez, 38, of San Jose on suspicion of homicide in connection with the case. The death is the city's 32nd homicide of the year.
Police said at 2:41 p.m. April 11, San Jose fire and ambulance paramedics went to a home on the 2100 block of Mendota Way, responding to a report that a child was in distress.
The boy was taken to Regional Medical Center, where he was pronounced dead.
Police said the boy was being cared for by a babysitter. Benitez is the babysitter's boyfriend.
Benitez was booked on suspicion of homicide with special circumstances. He is currently in the Santa Clara County main jail, with bail set at $500,000.
