SAN JOSE -- A registered sex offender is back in jail after he was arrested in the sexual assault of a woman behind The Plant shopping center over the weekend, according to the San Jose Police Department.

Michael Albert Garcia, 59, of San Jose, was booked into the Santa Clara County Jail on suspicion of sexual assault and forced oral copulation involving an adult female victim, police said. He is being held without bail for violating parole.

Police say that around 12:45 p.m. Saturday, a motorist saw a man and a woman struggling with each other in the 2100 block of Monterey Road. The passer-by flagged down officers patrolling in the area, and the officers broke up the fracas and arrested Garcia.

The victim was taken to a hospital where she was treated for injuries that aren't considered life-threatening, police spokesman Officer Albert Morales said.
