A local taxpayers' group that lost a legal bid to remove a 1/8th cent sales tax measure from the Nov. 6 ballot filed an appeal Tuesday with the 6th District Court of Appeal, and is seeking a ruling by Friday.
The Silicon Valley Taxpayers' Association last month sued the county, its Board of Supervisors and the Registrar of Voters over Measure A on the grounds that it violates a provision of state law.
The group contends that Prop. 218 says the tax measure must appear in a regularly scheduled general election along with local candidates -- in this case county supervisors -- on the same ballot. But a Santa Clara County Superior Court jJudge on Friday disagreed with that interpretation, and ruled against the taxpayers' group.
The group is asking the court of appeal to stay the printing of Measure A and related materials in the voter pamphlet on the ballot. It is asking for a ruling by Friday, which is the registrar's deadline to assemble materials to print on the ballot.
