Usher and ex-wife Tameka Foster Raymond are headed back to court.

Judge John J. Goger on Tuesday scheduled an emergency custody hearing at Raymond's request after her 5-year-old son with Usher almost drowned at the singer's Atlanta home. The hearing is scheduled for Friday.

Raymond's court filing says Usher Raymond V "suffered a near-death accident" while left unsupervised in a pool on Monday. The boy's arm got stuck in a pool drain. After a housekeeper was unable to free him, police reports say, the boy was rescued and received CPR by a contractor working at the house.

Emergency medical workers found the boy "conscious, alert and breathing" when they arrived, the police report says. Raymond's legal filing listed him as still being in the intensive care unit Tuesday.

Usher's lawyers have not yet responded to reports of the hearing.

Usher and Raymond have two sons. After divorcing in 2009, they went through a long custody battle that ended with Usher receiving primary custody of his sons last year.

In the court filing, Raymond said her ex-husband leaves the children with caregivers while he travels for his work and that she is capable of caring for the boys while Usher is absent.
